These terms and conditions apply to all contracts for the rental of apartments for accommodation, which are concluded between Besighomes with third parties (tenants) and for all other services and supplies supplied by Besighomes (accommodation contract).
By making a reservation, the tenant offers to conclude an accommodation contract. If the booked apartment is available, the tenant will receive a confirmation from Besighomes. By accepting the reservation made by the tenant, an accommodation agreement between Besighomes and the tenant is concluded. Offers from Besighomes regarding available apartments are non-binding. Besighomes may, at its discretion, decline to enter into a rental agreement. There is no entitlement to use the accommodation service in a specific apartment. Besighomes reserves the right to define industry-specific restrictions such as minimum stays, booking guarantees or down payment for certain dates.
3. Cancellation deadlines
A guaranteed reservation occurs when the tenant confirms the payment for the overnight accommodation service by providing a valid credit card number with the expiry date or by prepayment. A guaranteed reservation can be canceled free of charge up to 2 days before the arrival date, giving details of the apartment number (excluding long-term bookings in accordance with section 12). In the case of no-shows or late cancellations, we reserve the right to charge 100% of the total booking but at least the first 2 nights booked. Simple reservations, i. Reservations for payment by the guest not yet guaranteed, are valid until 18:00 of the day of arrival. After 6 pm the reservation will be forfeited automatically and free of charge. Besighomes is entitled to rent the reserved apartment elsewhere.
4. Overnight prices and other prices
The prices stated by Besighomes apply at the time of the conclusion of the contract. The applicable prices are gross prices and include all legal taxes, fees and charges. Not included are local taxes, which are owed by the tenant according to the local law, such as visitor's tax. Besighomes reserves the right to adjust prices in the event of changes in tax, fee and royalty rates, as well as effective collection of new taxes, fees and charges unprecedented to the parties. For contracts with consumers, this only applies if the period between the conclusion of the contract (booking confirmation) and the contract adjustment exceeds four months.
5. Terms of payment
The price of the entire booked accommodation service is always to be paid in advance by the tenant, at the latest on arrival. A set-off of the tenant is excluded, unless the set-off concerns an undisputed or legally established claim. Valid means of payment are cash in Euro, EC card, Master Card and Visa Card.
6. Usability of reserved apartments
Reserved apartments are available to the tenant from 16.00 on the day of arrival and until 11.00 on the day of departure. On request and subject to availability, a late check out (late check-out) with the Besighomes can be arranged in advance. If the Besighomes agrees to a late check-out, Besighomes is entitled to charge EUR 10.00 per additional hour for the additional use of the room. For departures after 11.00, the full daily price of the room will be charged. There is no contractual entitlement to a late check-out.
The resale / rental and / or the transfer of booked apartments is prohibited. The assignment or sale of the claim against Besighomes is also not permitted. In these cases, Besighomes is entitled to cancel the booking, in particular if the tenant has given false information about the type of booking or the payment to the third party during the assignment / sale. Use of the apartments for any purpose other than the accommodation is expressly prohibited.
8. Liability of Besighomes
Besighomes is liable for damages caused by it for the loss of life, body or health. Furthermore, Besighomes is liable for other damages that are based on a willful or grossly negligent breach of duty by Besighomes as well as for damages that are based on an intentional or negligent violation of contractual obligations. A breach of duty by Besighomes is equal to that of its legal representatives, employees or vicarious agents. Further claims for damages are excluded unless otherwise stipulated in these Terms and Conditions. In the event of any disruption or defect in the services of Besighomes, Besighomes will make every effort to remedy the situation, if the tenant knows or is promptly notified. The tenant is obligated to contribute reasonable things to remedy the disturbance and minimize possible damage. Incidentally, the tenant is obliged to inform Besighomes in due time about the possibility of causing an exceptionally high level of damage. For imported goods, Besighomes is liable according to the legal regulations. The claim expires, if the tenant does not announce immediately after getting the knowledge of loss, destruction or damage of the introduced thing Besighomes. Besighomes assumes no liability for valuables. Besighomes is liable for all damages under the provisions of this clause 8. Besighomes is not liable for damages that are the sole responsibility of other tenants or other third parties. In particular, Besighomes is also not liable for application errors. All claims against Besighomes expire in principle within one year from the statutory limitation period. This does not apply to claims for damages or other claims arising from injury to life, limb or health and / or due to a grossly negligent or intentional breach of duty by Besighomes.
9. Termination of the guest reception contract
Besighomes is entitled to terminate the accommodation contract for good cause. An important reason exists in particular if force majeure or other circumstances for which Besighomes is not responsible make the fulfillment of the contract impossible, rooms or rooms are culpably booked with misleading or false information or omission of material facts; In the process, the identity of the tenant, solvency or purpose of residence may have a significant bearing on Besighome's reasonable belief that the use of the service may jeopardize the smooth operation, safety or reputation of Besighomes in the public domain without or organizational area of Besighomes; the purpose or occasion of the stay is unlawful; or in case of resale / leasing and / or brokering (see paragraph 7).
10. Smoking ban
The apartments are non-smoking. It is therefore forbidden to smoke both in the public areas and in the rooms. In the event of an infringement, Besighomes shall have the right to demand compensation of EUR 200.00 from the tenant as compensation for the separately applicable cleaning costs, including any loss of sales resulting from the inability to rent the room. This compensation amount is higher or lower if Besighomes proves a higher or the tenant a lower damage.
Generally, pets are not allowed.
12. Long-term bookings
Long-term bookings (stay of at least 30 nights in a row) are subject to separate payment and cancellation conditions, which result from the respective contracts.
14. Final provisions
Changes and additions to the contract or the general terms and conditions must be in writing. Unilateral changes or additions by the tenant are ineffective. The place of jurisdiction for all disputes between the parties arising from the contractual relationship is Besigheim. German law applies. The application of the UN Sales Convention is excluded.
